BY ACCESSING OR USING ATTYSCORE.COM, INCLUDING BY MERELY VIEWING, SEARCHING, INGESTING, DOWNLOADING, UPLOADING, RECEIVING, OR OTHERWISE INTERACTING WITH INFORMATION GENERATED, DISPLAYED, PROCESSED, SUMMARIZED, ANALYZED, OR PRESENTED BY THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE HAD AN OPPORTUNITY TO REVIEW THESE TERMS AND THAT YOU AGREE TO BE LEGALLY BOUND BY THEM TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

1. PARTIES AND ACCEPTANCE
These Terms of Service ("Terms," "Agreement," or "Terms of Service") constitute a legally binding agreement between you ("User," "you," or "your") and ATTYSCORE.COM, together with its owners, operators, parent companies, subsidiaries, affiliates, licensors, licensees, contractors, service providers, technology providers, data providers, developers, officers, directors, employees, agents, representatives, successors, assigns, and other protected persons and entities collectively referred to as "ATTYSCORE," "Company," "we," "us," or "our."
By accessing or using the Service, you acknowledge that you have read, understood, and agreed to these Terms.
Your agreement is not limited to clicking an acceptance button.
To the maximum extent permitted by applicable law, your agreement may be evidenced by any of the following:
creating an account;
accessing the website;
searching for an attorney;
viewing an attorney profile;
viewing a scorecard;
purchasing a product or service;
uploading a document;
submitting information;
requesting an AI analysis;
viewing an AI-generated response;
downloading or saving information;
using a case-analysis tool;
using a case-management tool;
using a document-analysis feature;
receiving or accessing information generated by the Service;
continuing to use the Service after being presented with these Terms;
clicking an acceptance, continuation, registration, purchase, or similar button; or
otherwise using any portion of the Service.
Where legally required, ATTYSCORE may additionally require affirmative electronic assent, including a checkbox, clickwrap acceptance, electronic signature, or similar mechanism.
2. DEFINITIONS
For purposes of these Terms:
"Service" means ATTYSCORE.com and every associated website, webpage, mobile application, software system, database, API, artificial-intelligence system, machine-learning system, search system, attorney profile, scorecard, report, analysis, case-management feature, document-analysis feature, communication feature, subscription, product, and related service.
"Public Records" means information lawfully available from courts, government agencies, governmental databases, public records repositories, public filings, court dockets, opinions, orders, judgments, motions, pleadings, case records, attorney directories, disciplinary records, publicly accessible governmental sources, and other information made publicly available by governmental or other lawful sources.
"Generated Information" means information generated, summarized, classified, scored, ranked, extracted, organized, translated, interpreted, predicted, or otherwise processed by ATTYSCORE's software, algorithms, artificial-intelligence systems, machine-learning systems, databases, or other technology.
"Attorney Scorecard" means any statistical, analytical, comparative, informational, or graphical representation concerning an attorney's publicly available case history or other information.
"Case Intelligence" means any feature designed to organize, summarize, explain, categorize, or analyze information supplied by a User or obtained from lawful sources.
"AI" means artificial intelligence, machine learning, large-language models, natural-language processing, automated extraction, automated classification, statistical modeling, algorithmic processing, or similar technology.
3. THE FUNDAMENTAL PURPOSE OF ATTYSCORE
ATTYSCORE is an information and technology platform.
ATTYSCORE is not a law firm.
ATTYSCORE is not a lawyer.
ATTYSCORE is not a court.
ATTYSCORE is not a governmental agency.
ATTYSCORE is not a bar association.
ATTYSCORE is not an attorney-client relationship.
ATTYSCORE does not represent Users.
ATTYSCORE does not act as legal counsel for Users.
ATTYSCORE does not provide legal representation.
ATTYSCORE does not establish an attorney-client relationship merely because a User accesses, uploads, downloads, purchases, views, receives, or relies upon information provided through the Service.
The Service exists to provide technology-assisted access to information and analysis.
4. PUBLIC-RECORD INFORMATION
A fundamental component of ATTYSCORE is the collection, organization, analysis, indexing, summarization, and presentation of information derived from Public Records and other lawfully obtained information.
Users expressly acknowledge that court records and other governmental records are frequently created, maintained, filed, indexed, transmitted, or published by third parties.
ATTYSCORE does not control the accuracy, completeness, timeliness, availability, formatting, indexing, or underlying reliability of every Public Record.
ATTYSCORE may rely upon information that:
contains errors;
contains omissions;
is incomplete;
is duplicated;
has been amended;
has been sealed;
has been expunged;
has been incorrectly indexed;
contains typographical errors;
identifies individuals incorrectly;
contains outdated information;
contains incomplete procedural histories;
lacks context;
contains inconsistent information;
is subsequently corrected;
is subject to competing interpretations; or
is otherwise inaccurate.
ATTYSCORE does not represent or warrant that every Public Record is accurate merely because it originated from a court, governmental entity, public database, third-party database, or other apparently authoritative source.
5. ATTYSCORE IS AN INFORMATION TOOL — NOT A LEGAL DECISION-MAKER
ATTYSCORE does not determine whether an attorney is competent or incompetent.
ATTYSCORE does not determine whether an attorney is ethical or unethical.
ATTYSCORE does not determine whether an attorney will win or lose a case.
ATTYSCORE does not predict with certainty the outcome of any litigation.
ATTYSCORE does not determine whether a legal strategy is correct.
ATTYSCORE does not determine whether a motion should be filed.
ATTYSCORE does not determine whether a person should hire, fire, retain, replace, sue, report, discipline, or otherwise act against an attorney.
Any score, ranking, percentage, probability, trend, metric, comparison, estimate, classification, summary, or other analytical output is informational only.
A score is not a guarantee.
A ranking is not a guarantee.
A probability is not a guarantee.
A historical result is not a prediction.
A historical outcome does not establish future performance.
A correlation does not establish causation.
A statistical relationship does not establish professional competence.
6. NO LEGAL ADVICE
ALL INFORMATION PROVIDED THROUGH ATTYSCORE IS PROVIDED FOR GENERAL INFORMATIONAL, EDUCATIONAL, RESEARCH, ORGANIZATIONAL, AND TECHNOLOGICAL PURPOSES ONLY.
NOTHING PROVIDED BY ATTYSCORE CONSTITUTES LEGAL ADVICE.
NOTHING PROVIDED BY ATTYSCORE SHOULD BE CONSTRUED AS LEGAL ADVICE.
NOTHING PROVIDED BY ATTYSCORE SHOULD BE USED AS A SUBSTITUTE FOR CONSULTATION WITH A LICENSED ATTORNEY.
Users remain solely responsible for obtaining professional legal advice concerning their individual circumstances.
A User's decision to act, refrain from acting, file a document, contact an attorney, select an attorney, reject an attorney, negotiate, settle, litigate, appeal, plead, respond, or otherwise make a legal decision remains solely the User's responsibility.
7. NO ATTORNEY-CLIENT RELATIONSHIP
Use of ATTYSCORE does not create an attorney-client relationship.
Communications with ATTYSCORE personnel, automated systems, artificial-intelligence systems, contractors, affiliates, or service providers do not create an attorney-client relationship.
Uploading a complaint, motion, order, transcript, pleading, correspondence, evidence, legal document, or other material does not create an attorney-client relationship.
Receiving an AI-generated explanation does not create an attorney-client relationship.
Purchasing a subscription or other paid feature does not create an attorney-client relationship.
Using an attorney-search or attorney-comparison feature does not create an attorney-client relationship.
8. ARTIFICIAL INTELLIGENCE DISCLAIMER
ATTYSCORE may use artificial intelligence, machine learning, automated document processing, natural-language processing, statistical algorithms, automated extraction, and other computational technologies.
AI systems can produce incorrect, incomplete, outdated, misleading, or nonsensical information.
AI systems may misinterpret legal terminology.
AI systems may fail to recognize procedural context.
AI systems may improperly associate information with an individual.
AI systems may fail to recognize amendments, corrections, sealing orders, expungements, dismissals, appeals, or other subsequent events.
AI systems may produce summaries that omit information.
AI systems may produce classifications that are incorrect.
AI systems may produce recommendations or explanations that should not be relied upon without independent verification.
Users expressly acknowledge these limitations.
ATTYSCORE does not warrant that AI-generated information is correct.
ATTYSCORE does not warrant that AI-generated information is complete.
ATTYSCORE does not warrant that AI-generated information is current.
ATTYSCORE does not warrant that AI-generated information is suitable for any particular legal matter.
Users must independently verify material information before relying upon it.
9. USER RESPONSIBILITY FOR VERIFICATION
The User has the sole and exclusive responsibility for independently verifying information before relying upon it.
This obligation includes, without limitation:
verifying court records;
verifying docket entries;
verifying attorney identities;
verifying case numbers;
verifying dates;
verifying judgments;
verifying orders;
verifying procedural history;
verifying attorney status;
verifying disciplinary information;
verifying quotations;
verifying legal authorities;
verifying deadlines;
verifying statutes;
verifying court rules;
verifying applicable law.
ATTYSCORE shall not be responsible for a User's failure to independently verify information.
10. NO GUARANTEE OF OUTCOME
ATTYSCORE makes no representation that any User will:
win a case;
obtain a favorable ruling;
obtain a settlement;
obtain a favorable judgment;
obtain damages;
defeat a motion;
prevail on appeal;
obtain an attorney;
select an appropriate attorney;
avoid litigation;
avoid legal expenses;
avoid attorney fees;
avoid sanctions;
avoid deadlines;
avoid adverse consequences.
Any historical attorney performance information is inherently backward-looking.
Past performance is not a guarantee of future performance.
11. ATTORNEY SCORECARD METHODOLOGY
Attorney scorecards may be generated using Public Records, court information, statistical calculations, automated extraction, data normalization, machine-learning systems, and other methodologies.
A scorecard may consider information such as:
case outcomes;
motion outcomes;
procedural events;
case duration;
resolution velocity;
court appearances;
case types;
jurisdiction;
judge;
opposing counsel;
procedural posture;
docket activity;
publicly available filings;
publicly available orders;
publicly available judgments;
publicly available opinions;
attorney participation;
historical litigation activity.
The existence of a metric does not mean that the metric is a complete measure of attorney quality.
A scorecard is not a disciplinary finding.
A scorecard is not a bar determination.
A scorecard is not a professional-competence determination.
A scorecard is not a statement that an attorney violated any law or ethical rule.
12. ATTORNEY IDENTITY AND DATA MATCHING
ATTYSCORE may use automated and human-assisted processes to associate records with attorneys.
Those processes may include name normalization, matching, fuzzy matching, middle-initial matching, suffix matching, firm matching, jurisdiction matching, case-number matching, and other data-association methods.
Because multiple people may share identical or similar names, ATTYSCORE cannot guarantee that every record has been correctly attributed.
Users agree not to treat an automated identity association as conclusive proof of identity.
13. NO DEFAMATORY INTENT
ATTYSCORE does not intend to defame, disparage, injure, harass, threaten, or improperly interfere with any attorney, law firm, litigant, judge, court employee, governmental employee, business, or other person.
Information concerning attorneys is presented as informational analysis based upon available data and methodology.
ATTYSCORE does not knowingly publish false statements of fact.
Nothing in these Terms prevents a person from asserting a legally valid claim that cannot lawfully be waived.
Nothing in these Terms should be interpreted as an admission that any particular statement is defamatory, false, actionable, or otherwise unlawful.
14. FREEDOM OF SPEECH AND LAWFUL INFORMATION
To the maximum extent permitted by applicable law, ATTYSCORE reserves and exercises its right to publish, communicate, summarize, analyze, compare, organize, index, display, and discuss lawfully obtained information.
This includes information contained within Public Records and other information lawfully available to the public.
ATTYSCORE may provide commentary, statistical analysis, summaries, comparisons, and other informational transformations of publicly available information.
Nothing in these Terms constitutes an assertion that ATTYSCORE possesses an absolute constitutional immunity from every civil claim.
Rather, ATTYSCORE expressly preserves all rights, defenses, privileges, immunities, constitutional protections, statutory protections, common-law protections, and other defenses available under applicable law.
15. SECTION 230 NOTICE
To the extent applicable, ATTYSCORE intends to operate within the protections provided by Section 230 of the Communications Decency Act, including 47 U.S.C. § 230.
Where information is supplied by a User or another third-party information-content provider, ATTYSCORE does not assume responsibility for the creation or development of that information merely by providing technological means for its transmission, organization, storage, display, or access.
Nothing in these Terms expands or contracts the statutory scope of Section 230.
Section 230 expressly provides protection concerning information supplied by another information-content provider, subject to the statute's terms and exceptions. 47 U.S.C. § 230. (Legal Information Institute)
ATTYSCORE reserves all defenses available under Section 230 and any successor, replacement, amendment, implementing law, or applicable judicial interpretation.
16. CONSUMER REPORTING AND FAIR CREDIT REPORTING LAWS
ATTYSCORE is intended to provide legal-information and legal-technology services rather than consumer reports for employment, credit, insurance, housing, or other eligibility purposes governed by consumer-reporting statutes.
Users agree not to use ATTYSCORE information for purposes prohibited by applicable consumer-reporting laws.
Nothing in these Terms authorizes any User to use ATTYSCORE information for an unlawful eligibility determination.
ATTYSCORE does not waive, disclaim, or contract around rights or obligations that cannot legally be waived under the Fair Credit Reporting Act ("FCRA"), state consumer-reporting statutes, or other applicable law.
Where the FCRA or another consumer-reporting statute legally applies to a particular use, transaction, dataset, or activity, the parties' rights and obligations shall be determined by the applicable law.
No contractual provision in these Terms is intended to convert a non-consumer-report into a consumer report, or a consumer report into a non-consumer-report.
Users shall not represent that ATTYSCORE has authorized an otherwise unlawful use of its information.
17. PUBLIC RECORDS ARE NOT A WARRANTY
The fact that information appears in a court record or government record does not constitute a warranty by ATTYSCORE that the underlying allegation, accusation, argument, statement, filing, or factual assertion contained in that record is true.
Court filings frequently contain allegations made by parties.
An allegation is not necessarily a finding.
A motion is not necessarily a ruling.
A pleading is not necessarily evidence.
A filing is not necessarily a judgment.
A lawsuit is not proof that the defendant committed the alleged conduct.
A criminal charge is not proof of guilt.
An attorney's representation of a party does not mean that the attorney personally endorses every factual allegation made by that party.
ATTYSCORE may display or analyze such information because it exists within a publicly available record.
Users agree to understand the distinction between allegations, evidence, findings, rulings, judgments, and other procedural events.
18. NO RELIANCE
YOU EXPRESSLY AGREE THAT YOU ARE NOT RELYING UPON ATTYSCORE AS YOUR SOLE SOURCE OF INFORMATION FOR ANY MATERIAL LEGAL, FINANCIAL, BUSINESS, PROFESSIONAL, OR PERSONAL DECISION.
You acknowledge that you are capable of independently investigating matters material to your decision.
You acknowledge that ATTYSCORE is a technological information service rather than a substitute for independent professional investigation.
19. CASE MANAGEMENT FEATURES
ATTYSCORE may provide case timelines, document organization, deadline reminders, summaries, procedural explanations, transcript summaries, case histories, attorney-review packages, and related features.
These features are organizational and informational tools.
They are not legal representation.
They are not a substitute for a court clerk, attorney, court order, statute, procedural rule, or official court notice.
Users remain responsible for independently confirming every legal deadline.
A missed deadline resulting from a failure of the Service, an AI system, a User, a third-party provider, an incorrect record, a synchronization error, a data delay, a technical failure, or any other circumstance shall not create liability beyond the maximum amount permitted under applicable law.
20. THIRD-PARTY DATA PROVIDERS
ATTYSCORE may obtain information from third-party databases, governmental sources, court systems, APIs, data providers, vendors, contractors, and other sources.
ATTYSCORE does not control those third parties.
ATTYSCORE does not guarantee their availability.
ATTYSCORE does not guarantee their accuracy.
ATTYSCORE does not guarantee their continuity.
ATTYSCORE is not responsible for third-party outages, delays, corruption, errors, omissions, changes, discontinued services, API limitations, pricing changes, or data-access restrictions.
21. NO WARRANTY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS."
ATTYSCORE DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF:
MERCHANTABILITY;
FITNESS FOR A PARTICULAR PURPOSE;
NON-INFRINGEMENT;
ACCURACY;
COMPLETENESS;
RELIABILITY;
AVAILABILITY;
SECURITY;
TITLE;
CONTINUITY;
TIMELINESS;
ERROR-FREE OPERATION;
RESULTS;
SUITABILITY FOR LEGAL PURPOSES.
ATTYSCORE DOES NOT WARRANT THAT THE SERVICE WILL OPERATE WITHOUT INTERRUPTION, ERROR, DELAY, DEFECT, SECURITY VULNERABILITY, OR DATA LOSS.
22. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATTYSCORE AND ALL PROTECTED PARTIES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, ENHANCED, OR OTHER SIMILAR DAMAGES.
THIS INCLUDES, WITHOUT LIMITATION:
LOST PROFITS;
LOST REVENUE;
LOST BUSINESS;
LOST OPPORTUNITIES;
LOSS OF DATA;
LOSS OF REPUTATION;
LOSS OF GOODWILL;
LEGAL FEES;
ATTORNEY FEES;
LITIGATION EXPENSES;
BUSINESS INTERRUPTION;
LOST CASE VALUE;
LOST SETTLEMENT VALUE;
ADVERSE COURT RESULTS;
MISSED DEADLINES;
LOSS OF CLAIMS;
LOSS OF DEFENSES;
LOSS OF EVIDENCE;
EMOTIONAL DISTRESS;
REPUTATIONAL HARM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF ATTYSCORE AND ALL PROTECTED PARTIES ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF:
(A) THE AMOUNT ACTUALLY PAID BY THE USER TO ATTYSCORE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
(B) ONE HUNDRED U.S. DOLLARS ($100).
IF THE USER HAS PAID NOTHING TO ATTYSCORE, THE PARTIES AGREE THAT THE MAXIMUM AGGREGATE LIABILITY SHALL BE $100, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Nothing in this section shall be interpreted as waiving liability that applicable law expressly prohibits from being limited or waived.
23. RELEASE
TO THE MAXIMUM EXTENT PERMITTED BY LAW, USER RELEASES AND FOREVER DISCHARGES ATTYSCORE AND ALL PROTECTED PARTIES FROM CLAIMS ARISING FROM OR RELATED TO:
USE OF THE SERVICE;
INABILITY TO USE THE SERVICE;
INFORMATION OBTAINED THROUGH THE SERVICE;
PUBLIC RECORDS;
AI-GENERATED INFORMATION;
ATTORNEY SCORECARDS;
ATTORNEY RANKINGS;
CASE ANALYSIS;
CASE TIMELINES;
DOCUMENT SUMMARIES;
DATA ERRORS;
DATA OMISSIONS;
THIRD-PARTY DATA;
USER-GENERATED CONTENT;
ATTORNEY SELECTION;
ATTORNEY PERFORMANCE;
LITIGATION OUTCOMES;
LEGAL DECISIONS;
BUSINESS DECISIONS;
RELIANCE UPON INFORMATION;
FAILURE TO VERIFY INFORMATION.
This release applies to the maximum extent permitted by law.
24. ASSUMPTION OF RISK
YOU EXPRESSLY ASSUME ALL RISKS ASSOCIATED WITH YOUR USE OF THE SERVICE.
You acknowledge that:
court records may be incomplete;
databases may contain errors;
attorneys may share names;
cases may have incomplete histories;
AI systems can generate errors;
statistics can be misleading without context;
historical performance may not predict future performance;
court outcomes depend upon facts not reflected in databases;
procedural circumstances can materially affect outcomes;
judges differ;
jurisdictions differ;
opposing counsel differs;
clients differ;
legal strategies differ; and
no statistical score can fully measure attorney competence.
25. USER INDEMNIFICATION
To the maximum extent permitted by law, User agrees to defend, indemnify, and hold harmless ATTYSCORE and all Protected Parties from claims, liabilities, damages, losses, judgments, penalties, settlements, costs, and reasonable attorneys' fees arising out of or related to:
User's violation of these Terms;
User's misuse of the Service;
User's unlawful use of information;
User's violation of another person's rights;
User's uploaded content;
User's representations;
User's fraudulent activity;
User's violation of applicable law;
User's use of information obtained through the Service;
User's decisions based upon the Service; or
User's unauthorized use of another person's personal information.
This indemnification obligation shall survive termination of the User's account.
26. USER-GENERATED CONTENT
Users are solely responsible for information they upload, submit, transmit, or otherwise provide.
Users represent that they possess all rights necessary to provide such information to ATTYSCORE.
Users shall not knowingly upload unlawful, fraudulent, infringing, malicious, or unauthorized information.
ATTYSCORE may remove, restrict, preserve, disclose, or refuse to process content where ATTYSCORE reasonably believes doing so is necessary to comply with law, protect users, protect the Service, investigate abuse, or protect its rights.
27. NO GUARANTEE OF CONFIDENTIALITY
ATTYSCORE may employ commercially reasonable security measures but cannot guarantee absolute security.
Users should not submit information that they are legally prohibited from submitting.
Users should consider whether confidential, privileged, sealed, restricted, personally identifying, or sensitive information should be uploaded.
ATTYSCORE does not represent that uploading information creates attorney-client privilege, work-product protection, or any other legal privilege.
28. ATTORNEY-CLIENT PRIVILEGE WARNING
Do not assume that information submitted to ATTYSCORE is protected by attorney-client privilege.
ATTYSCORE is not your attorney.
The Service does not automatically create attorney-client privilege.
Users should consult their attorney regarding whether particular information should be uploaded.
29. NO PROFESSIONAL ENDORSEMENT
An attorney profile, score, ranking, comparison, or inclusion within ATTYSCORE does not constitute an endorsement.
Likewise, failure to include an attorney does not constitute criticism.
ATTYSCORE does not certify any attorney.
ATTYSCORE does not recommend that an attorney be hired merely because the attorney has a favorable score.
30. NO DEFAMATION GUARANTEE
ATTYSCORE does not represent that every statement or data point is immune from challenge.
The parties acknowledge that disputes concerning allegedly false statements may arise.
ATTYSCORE reserves all applicable privileges, defenses, immunities, constitutional protections, statutory protections, and common-law defenses.
Nothing in these Terms constitutes an admission concerning the truth or falsity of any particular information.
31. CORRECTION AND DISPUTE PROCEDURE
If an individual believes that information displayed by ATTYSCORE is materially inaccurate, that individual may submit a correction request through the Company's designated reporting mechanism.
ATTYSCORE may investigate the request.
ATTYSCORE may request supporting documentation.
ATTYSCORE may correct, supplement, annotate, restrict, or remove information when ATTYSCORE determines that correction is appropriate.
Nothing in this section requires ATTYSCORE to remove truthful Public Records merely because the subject dislikes the information.
Nothing in this section constitutes an admission that disputed information is false.
32. NO AUTOMATIC DUTY TO REMOVE PUBLIC RECORDS
ATTYSCORE is not required to remove information merely because the subject of that information objects to its publication, provided that ATTYSCORE's publication or use is lawful.
ATTYSCORE may nevertheless voluntarily review disputed information.
Any voluntary review does not constitute an admission of liability.
33. DMCA AND INTELLECTUAL PROPERTY
ATTYSCORE respects applicable intellectual-property rights.
Nothing in these Terms grants Users ownership of ATTYSCORE's proprietary software, algorithms, databases, trademarks, designs, methodologies, interfaces, scorecard systems, or technology.
ATTYSCORE retains all rights not expressly granted.
34. PROHIBITED USES
Users shall not:
scrape ATTYSCORE without authorization;
reverse engineer the Service;
circumvent access controls;
manipulate scorecards;
interfere with databases;
submit fraudulent information;
create fraudulent accounts;
use the Service for unlawful discrimination;
use information for unlawful consumer-reporting purposes;
harass attorneys or litigants using ATTYSCORE information;
threaten individuals based upon information obtained through ATTYSCORE;
impersonate ATTYSCORE;
represent themselves as ATTYSCORE;
interfere with the operation of the Service;
use automated systems in violation of applicable restrictions;
attempt to discover confidential system information;
use the Service to facilitate unlawful activity.
35. TERMINATION
ATTYSCORE may suspend or terminate access to the Service at any time, with or without notice, to the maximum extent permitted by law.
ATTYSCORE may terminate accounts for suspected fraud, abuse, unlawful activity, security threats, violation of these Terms, misuse of information, or other legitimate reasons.
Termination does not eliminate provisions intended to survive termination.
36. ARBITRATION AGREEMENT
PLEASE READ THIS SECTION CAREFULLY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY DISPUTE, CLAIM, CONTROVERSY, OR CAUSE OF ACTION ARISING OUT OF OR RELATING TO THE SERVICE, THESE TERMS, THE PARTIES' RELATIONSHIP, ANY INFORMATION PROVIDED THROUGH THE SERVICE, ANY TRANSACTION, OR ANY ALLEGED INJURY SHALL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN THROUGH COURT LITIGATION, EXCEPT WHERE APPLICABLE LAW EXPRESSLY PROHIBITS ARBITRATION.
THE FEDERAL ARBITRATION ACT SHALL GOVERN THE INTERPRETATION AND ENFORCEMENT OF THIS ARBITRATION AGREEMENT TO THE MAXIMUM EXTENT APPLICABLE.
The arbitration shall be conducted by a mutually agreed arbitrator or, if the parties cannot agree, through the applicable arbitration provider's selection procedures.
The arbitrator shall have authority to award any remedy that a court of competent jurisdiction could lawfully award to an individual claimant, subject to these Terms and applicable law.
The arbitrator shall not have authority to award relief that would be unavailable under applicable law.
37. COMPANY ELECTION TO REQUIRE ARBITRATION
To the maximum extent permitted by law, ATTYSCORE may elect to require an otherwise arbitrable dispute to proceed through arbitration.
However, this provision shall not be interpreted to grant ATTYSCORE authority to eliminate a non-waivable statutory right or legally protected remedy.
Where a court determines that a particular dispute is not legally subject to mandatory arbitration, that dispute shall proceed in the legally appropriate forum.
38. INDIVIDUAL ARBITRATION ONLY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARBITRATION SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS.
The arbitrator shall not consolidate claims of unrelated Users without the express written agreement of ATTYSCORE.
The arbitrator shall not conduct a class arbitration.
The arbitrator shall not issue relief benefiting persons who are not parties to the arbitration.
39. CLASS-ACTION WAIVER
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU WAIVE THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, MASS ACTION, REPRESENTATIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR CONSOLIDATED ACTION AGAINST ATTYSCORE.
YOU AGREE THAT ANY CLAIM YOU MAY HAVE AGAINST ATTYSCORE MUST BE ASSERTED INDIVIDUALLY.
If applicable law prohibits waiver of a particular representative claim, that claim shall be severed to the minimum extent required by law.
40. JURY-TRIAL WAIVER
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND ATTYSCORE KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY FOR ANY DISPUTE SUBJECT TO THESE TERMS.
The parties intend this waiver to be enforceable to the maximum extent permitted by applicable law.
41. SMALL-CLAIMS EXCEPTION
Nothing in these Terms prevents an individual User from bringing an eligible claim in small-claims court where applicable law permits such a claim to proceed there notwithstanding the arbitration agreement.
ATTYSCORE reserves the right to require arbitration where legally permitted.
42. PRE-DISPUTE NOTICE
Before initiating arbitration, the claimant shall provide ATTYSCORE with written notice describing:
the claimant's name;
the nature of the dispute;
the facts supporting the claim;
the relief requested;
the amount claimed, if known; and
the claimant's contact information.
The parties shall attempt in good faith to resolve the dispute before arbitration.
This requirement shall not apply where applicable law prohibits such a requirement.
43. GOVERNING LAW
These Terms shall be governed by the laws of the State of [INSERT STATE], without regard to conflict-of-law principles, except to the extent federal law governs.

A single waiver does not constitute a continuing waiver.

The following provisions survive termination:
disclaimers;
limitations of liability;
releases;
indemnification;
arbitration;
class-action waiver;
jury waiver;
governing law;
intellectual-property provisions;
dispute-resolution provisions;
confidentiality provisions;
payment obligations;
any other provisions that by their nature should survive.
49. ENTIRE AGREEMENT
These Terms constitute the entire agreement between User and ATTYSCORE concerning the Service and supersede prior oral or written representations concerning the subject matter.
Additional terms may apply to specific products or services.
If a product-specific agreement conflicts with these Terms, the product-specific agreement shall control only to the extent expressly stated.
50. MODIFICATION OF TERMS
ATTYSCORE may modify these Terms from time to time.
Updated Terms may be posted on the Service.
Where legally required, ATTYSCORE may provide additional notice or request renewed acceptance.
Continued use following legally sufficient notice constitutes acceptance to the extent permitted by law.
51. ELECTRONIC RECORDS AND SIGNATURES
User agrees that electronic records, electronic signatures, clickwrap acceptance, account records, authentication logs, timestamps, IP logs, transaction records, and similar electronic evidence may be used to establish acceptance and use of these Terms to the maximum extent permitted by applicable law.
52. NO ORAL MODIFICATION
No oral statement by an employee, contractor, agent, automated system, or other representative of ATTYSCORE shall modify these Terms unless expressly authorized in writing.
53. THIRD-PARTY BENEFICIARIES
The Protected Parties are intended third-party beneficiaries of all provisions protecting them.

technology providers;

service providers;

54. NO PERSONAL LIABILITY OF OWNERS OR PERSONNEL
To the maximum extent permitted by law, no individual owner, officer, director, employee, contractor, agent, developer, or representative shall have personal liability for obligations arising from the Service where such liability can lawfully be excluded.
Any claim must first be asserted against the appropriate contracting entity.
55. FORCE MAJEURE
ATTYSCORE shall not be responsible for failure or delay caused by circumstances beyond its reasonable control, including:
internet outages;
cyberattacks;
governmental actions;
court-system outages;
database outages;
API outages;
natural disasters;
war;
terrorism;
civil disturbances;
labor disputes;
infrastructure failures;
telecommunications failures;
cloud-provider failures;
data-provider failures;
power failures;
regulatory changes;
unforeseen technological failures.
56. THIRD-PARTY SERVICES
ATTYSCORE may integrate with third-party services.
Those services are controlled by their respective providers.
ATTYSCORE is not responsible for third-party policies, availability, content, security, pricing, functionality, or conduct.
57. ATTORNEY SELECTION
If ATTYSCORE provides attorney-search or attorney-matching functionality, Users acknowledge that any matching process is informational.
ATTYSCORE does not guarantee that a recommended attorney is appropriate for the User.
ATTYSCORE does not guarantee attorney availability.
ATTYSCORE does not guarantee attorney competence.
ATTYSCORE does not guarantee attorney compatibility.
ATTYSCORE does not guarantee litigation success.
The final decision concerning whether to retain an attorney belongs exclusively to the User.
58. NO GUARANTEE OF CASE ANALYSIS
ATTYSCORE may analyze documents supplied by a User.
The analysis may omit relevant facts.
The analysis may misunderstand facts.
The analysis may misidentify legal issues.
The analysis may misunderstand procedural posture.
The analysis may fail to identify deadlines.
The analysis may incorrectly summarize a document.
The analysis may provide information that conflicts with the advice of a licensed attorney.
The User agrees that such output is informational and must be independently reviewed.
59. USER'S INDEPENDENT DUTY
The User retains complete responsibility for:
legal decisions;
litigation strategy;
filing decisions;
deadline compliance;
attorney selection;
document filing;
communications with courts;
communications with attorneys;
communications with opposing parties;
settlement decisions;
appeals;
preservation of evidence;
preservation of legal rights.
ATTYSCORE does not assume these responsibilities merely by providing technological assistance.
60. NO FIDUCIARY RELATIONSHIP
Use of ATTYSCORE does not create a fiduciary relationship.
ATTYSCORE is not a fiduciary.
ATTYSCORE does not undertake fiduciary duties toward Users except to the extent a non-waivable legal obligation applies.
61. NO GUARANTEE OF DATA RETENTION
Users should maintain their own copies of documents and information.
ATTYSCORE does not guarantee indefinite preservation of uploaded documents, case histories, reports, timelines, transcripts, or other information.
Technical failures, account termination, policy changes, storage limitations, legal obligations, security events, or third-party failures may result in loss or deletion of information.
62. LIMITATION ON USER CLAIMS
To the maximum extent permitted by law, any claim arising from the Service must be initiated within one (1) year after the event giving rise to the claim.
If applicable law prohibits contractual shortening of a limitation period, the statutory period shall apply.
63. NO CUMULATIVE LIABILITY
If multiple legal theories arise from the same event, those theories shall not create multiple recoveries for the same injury.
A User shall not recover duplicative damages.
64. MITIGATION
To the maximum extent permitted by law, Users shall take reasonable steps to mitigate alleged damages.
Failure to mitigate may be asserted as a defense.
65. ATTORNEY FEES
To the maximum extent permitted by applicable law, the prevailing party in any dispute concerning these Terms may seek recovery of reasonable attorneys' fees and costs where authorized by law or by the arbitrator/court.
Nothing in this provision creates a fee award where applicable law prohibits such an award.
66. CONSTRUCTION OF AGREEMENT
These Terms shall not be interpreted against ATTYSCORE merely because ATTYSCORE drafted them.

"Including" means including without limitation.
"May" means discretion and does not create an obligation unless expressly stated.
"Shall" and "must" indicate an obligation only where legally enforceable.
67. MAXIMUM LAWFUL PROTECTION
Every disclaimer, waiver, limitation, release, indemnification provision, arbitration provision, procedural restriction, and limitation contained in these Terms shall be interpreted to provide ATTYSCORE and the Protected Parties with the maximum protection legally available.
If a provision is enforceable in one jurisdiction but not another, it shall be enforced to the maximum extent permitted in each applicable jurisdiction.
68. ACKNOWLEDGMENT OF RISK
BY USING ATTYSCORE, YOU ACKNOWLEDGE THAT YOU UNDERSTAND THE TECHNOLOGICAL AND LEGAL RISKS ASSOCIATED WITH AUTOMATED INFORMATION PROCESSING.
YOU ACKNOWLEDGE THAT INFORMATION CAN BE WRONG.

YOU ACKNOWLEDGE THAT AI CAN BE WRONG.
YOU ACKNOWLEDGE THAT STATISTICS CAN BE MISLEADING.
YOU ACKNOWLEDGE THAT ATTORNEY PERFORMANCE CAN CHANGE.
YOU ACKNOWLEDGE THAT COURT CASES ARE FACT-SPECIFIC.
YOU ACKNOWLEDGE THAT A SCORE DOES NOT DEFINE AN ATTORNEY.
YOU ACKNOWLEDGE THAT A SCORE DOES NOT PREDICT A RESULT.
YOU ACKNOWLEDGE THAT YOU MUST INDEPENDENTLY VERIFY MATERIAL INFORMATION.
69. KNOWING ACCEPTANCE
BY USING THE SERVICE, YOU REPRESENT THAT:

you understand that ATTYSCORE does not provide legal advice;
you understand that the Service may use AI;
you understand that AI can make mistakes;
you understand that Public Records can contain errors;
you understand that scorecards are informational;
you understand that attorney performance metrics are not guarantees;
you understand the arbitration agreement;
you understand the class-action waiver;
you understand the jury-trial waiver;
you understand the limitation of liability;
you understand the release;
you understand the indemnification obligation; and
you voluntarily agree to these Terms to the maximum extent permitted by law.
70. FINAL USER ACKNOWLEDGMENT
YOU EXPRESSLY ACKNOWLEDGE THAT ATTYSCORE IS A TECHNOLOGICAL INFORMATION SERVICE DESIGNED TO HELP USERS ACCESS, ORGANIZE, ANALYZE, UNDERSTAND, COMPARE, AND WORK WITH INFORMATION.
YOU AGREE THAT ATTYSCORE DOES NOT CONTROL THE COURTS, ATTORNEYS, LITIGANTS, GOVERNMENT AGENCIES, DATABASE PROVIDERS, JUDGES, CASE OUTCOMES, OR UNDERLYING EVENTS THAT GENERATE THE RECORDS ANALYZED BY THE SERVICE.
